H2Ok Innovations Inc. (“H2Ok”, “we”, “us”) is committed to safeguarding your privacy. This Privacy Policy (“Policy”) describes H2Ok’s policies and procedures on the collection, use, and disclosure of your Personal Information. This Privacy Policy applies to the websites which link to the Policy – the “Sites.” We may update this Privacy Policy and we encourage you to check this Privacy Policy for updates.

CONTACT FORMS

When you visit the Sites, we collect Personal Information that you choose to disclose to us, such as your name and email address.  For purposes of this Policy, “Personal Information” is any information that can be related to a unique individual or household.

H2Ok may collect your name and email address if you contact us for general information purposes and request to be added to our contact lists. This information may be shared with a third party service provider for the purpose of providing you with the information you requested.

COOKIES AND OTHER TECHNOLOGIES

When you visit the Sites or receive emails from us, we may store or retrieve information on your browser or device, mostly in the form of cookies, but also in the form of third-party tracking tools, such as eTags, “zero pixle GIFs' ' and Google Analytics. This information might be about your use of the Sites, your interaction with any emails we send you, your user preferences, or your device. We generally use this information to improve your user experience of the Sites. This information may be aggregated with other users in an anonymous way to report to third parties, for example clients and funders. You can opt out of Google Analytics without affecting how you use the Sites, through this tool: https://tools.google.com/dlpage/gaoptout.

Note that the Sites will continue to operate as described in this Privacy Policy, whether or not a “Do Not Track” signal or similar mechanism is received from your browser. This is because the “Do Not Track” mechanism is a draft standard of the W3C and is not fully completed. However, you can opt out of cookies through your browser settings, although this may affect the functioning of the website.

 

Use

We collect, use and disclose your Personal Information in our normal course of business for the following purposes:

  • Establishing and maintaining communications with you;

  • Where you have requested information from us, assisting you in the completion of your request and the assessment of your eligibility for any such request;

  • Responding to your inquiries about our products or services;

  • Managing the application process for H2Ok positions;

  • Meeting legal, security, processing and regulatory requirements;

  • Protecting against fraud, suspicious or other illegal activities; and

  • Compiling statistics for analysis of the Sites and our business.

 

Disclosure

Similarly to how we use Personal Information, we may disclose Personal Information to service providers, and sometimes third parties, for various purposes. To this end, we may disclose Your Personal Information to the following entities for the purposes associated with each entity as noted below:

  • To our third-party service providers, who provide services such as website hosting, data storage, data analysis, payment processing, order fulfillment, IT services and infrastructure, customer service, email delivery and administration, credit card processing, auditing and other similar services to enable them to provide services;

  • To our subsidiaries and affiliated entities (collectively, our “Affiliates”) for marketing and other purposes as described in this Policy;

  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceeding); and

  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our Affiliates; (f) to protect our rights, privacy, safety or property, or that of you, our Affiliates or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

 

External Links and Websites

The Sites may include links to third-party websites, including social media platforms. H2Ok is not responsible for the privacy policies or practices of any of these linked third party websites, or the links within the linked websites. H2Ok recommends that you familiarize yourself with the privacy policies of any linked websites.

We are active on social media (e.g., Twitter, LinkedIn, etc.) and share information, images, and video with the public through unaffiliated external social media sites. We encourage you to read their policies.

 

Retention of Information

We keep Personal Information until no longer reasonably necessary for the purposes for which it was collected or other permitted use.

 

Reviewing, Changing, or Deleting Information

You may request to review, change, or delete any Personal Information you have on file with us at any time by sending an email to info@h2okinnovations.com .

 

State Privacy Rights

Certain jurisdictions provide their residents states a number of rights as they relate to Personal Information. These are the “right to know”, the “right to delete”, and the “right to opt-out”. We do not discriminate against you because you exercised any of your rights under applicable state law or this Privacy Policy.

Right to Know. You may request that H2Ok provide you the specific pieces of Personal Information that H2Ok has about you; categories of Personal Information we have collected about you; categories of sources from which the Personal Information is collected; categories of Personal Information that Form sold or disclosed for a business purpose about you; categories of third parties to whom the Personal Information was sold or disclosed for a business purpose; and the business or commercial purpose for collecting or selling Personal Information. Please note that much of the information you can make a request for is already contained in this Policy. Should you wish to exercise this right, please see the section below which explains how to do so. If you do not have an account with H2Ok, we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request.

Right to Delete. Some states have laws that give their residents a limited right to request deletion of their Personal Information. However, this right is limited by a number of exceptions. Fundamentally, if H2Ok has a permissible need to retain Personal Information, we are not under an obligation to delete such information, even when requested. Generally, we retain Personal Information so we may complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; debug to identify and repair errors that impair existing intended functionality of our online properties; enable solely internal uses that are reasonably aligned with your expectations based on your relationship with H2Ok; comply with a legal obligation; or otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which your provided the information. As such, we generally do not accept requests to delete Personal Information. However, we will respond to requests to remove Personal Information from some of our systems as a part of a request to close or otherwise disable a registered account. If you would like to request deletion of Personal Information, please see the section below which explains how to do so. If you do not have an account with H2Ok , we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request.

Right to Opt-Out. H2Ok does not share Personal Information with third parties for their marketing purposes. As such, H2Ok does not provide an “opt-out” for third party marketing.

Exercising privacy rights. If you are a resident of a jurisdiction which provides you the above rights and would like to exercise any of your rights you may do so by using the mechanisms noted in the “Contact” section below. Certain state law permits their residents to designate an agent to manage their rights under that state’s law. If you would like to designate an agent to manage your privacy preferences, you may do so by contacting us. Note that we may ask for some Personal Information in order to verify your identity and your rights to the data subject to your request. We will also need sufficient Personal Information about your authorized agent to be able to identify them. As part of this process, you must have permission from your authorized agent to disclose their Personal Information to us for the purpose of acting as your agent.

 

Security of Information

H2Ok is committed to the security of your information and we maintain reasonable procedures to protect your information. However no data transmission is completely secure and it could be unlawfully intercepted. H2Ok cannot and does not guarantee the security of any information you transmit to us through the Sites or other ways.

 

Data Collection from Children

H2Ok does not knowingly or intentionally collect information from children under the age of 13. If you are under the age of 13, please do not provide any Personal Information about yourself to us. CHANGES TO THIS PRIVACY POLICY

If there is any material change to your rights under this Policy, we will provide you with notice of such change 30 calendar days prior to the changes going into effect. As part of this notice, we may post a notice of the change on a Site in a clear and conspicuous manner for the 30 calendar day notice period. H2Ok may also communicate the change via email or postal or email if that is the way that we normally correspond with you.
